A recent Law Society Gazette investigation found that professional negligence claims against personal injury solicitors are increasing rapidly. Firms' reliance on under-qualified staff, lack of face-to-face contact with clients and failure to understand medical reports are all factors in the trend.
There are various potential causes of this kind of negligence. These might include one or more of the following:
  • Excessive pressure to settle at an early stage when the symptoms are ongoing
  • Settling on a "pre-medical" basis
  • Becoming liable for unrecovered credit hire charges or storage charges
  • Full impact of injuries have not been considered
  • A failure to take account of important matters of law
  • Liability has been incorrectly apportioned
  • Negligence in submitting documents
  • Has your solicitor missed a relevant time limit? Particularly a time limit to start a claim?
  • Failure to take out Before/After the Event insurance to cover against liability of costs and disbursements
If you feel that your clients personal injury compensation claim has been under settled or neglected, we will be more than happy to discuss it with your client and advise them about bringing a professional negligence claim on a no win – no fee basis, to recover the compensation that they have lost out on.
